1. Agreement to Terms

By accessing or using Scopit ("Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

Scopit provides a platform for construction contractors to document scope changes, price them, and obtain client approvals. We are not a party to any agreement between contractors and their clients.

3. User Responsibilities

You are responsible for:

  • Ensuring the accuracy of all information entered into the Service.
  • Complying with all local, state, national, and international laws, including consumer protection and contracting laws in your jurisdiction.
  • Protecting your account credentials and security.

4. Data Protection Responsibilities

When you enter a client's personal data (name, email address, phone number) into Scopit, you are acting as a data controller for that client's personal data under applicable data protection law (including the UK GDPR and EU GDPR). You are responsible for:

  • Having a lawful basis (typically your contractual relationship with the client) before entering their contact details into Scopit.
  • Ensuring your clients are aware that you may use digital tools to send them change orders for approval and that their contact information will be shared with Scopit for that purpose.
  • Handling any data subject requests from your clients relating to data you have entered on their behalf. Scopit will support you in responding to such requests where the data falls within our systems.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Scopit and its licensors.

6. Limitation of Liability

To the maximum extent permitted by law, Scopit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you for the Service in the last 12 months.

7. Dispute Resolution

Any disputes arising from these Terms will be governed by the laws of England and Wales, without regard to conflict of law provisions. The parties submit to the exclusive jurisdiction of the courts of England and Wales.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of material changes by email. Your continued use of the Service after changes are posted constitutes acceptance of the new Terms.
